Tort law applies to any civil case where the party bringing the action is seeking compensation for damages; any civil wrong that causes harm. The harm is generally a personal injury and the victim of the tort is seeking financial damages; which can include lost wages, medical expenses, mental and physical pain, loss of enjoyment of life. 

A party bringing a civil lawsuit will seek damages that have occurred in the past and any damages that are reasonably certain to happen in the future. Future damages are set by the jury at the time of the trial. There is a risk that unanticipated damages will occur in the future and compensation for those damages would be lost, so in order to receive full compensation a lawsuit is not instituted until the injured party has reached maximum medical improvement.

Torts include all types of negligence and can be caused by intentional wrongdoing, negligence or strict liability.
