In an article for the Sarasota Herald Tribune, Florida personal injury attorney Theodore Babbitt explains personal injury protection coverage.
PIP coverage is required as a part of Florida’s automobile insurance. Up to the limit of the insurance, this coverage pays the driver or passenger’s bills without regard to fault.
This no-fault coverage pays 80% of all medical bills; 60% of all lost wages and also covers the insured regardless of the vehicle they are driving.
If an injury is serious enough to meet one of the following thresholds, then a lawsuit for damages not covered by PIP may be filed:
- A significant and permanent loss of an important bodily function
- A permanent injury within a reasonable degree of medical probability
- Significant and permanent scarring or disfigurement
- Death
